What is a no win no fee claim?

Also known as a conditional fee agreement, a no win no fee agreement is a means of funding the legal process of claiming compensation without the need to pay any upfront costs or leaving you at any financial risk if you lose your case.

Under the agreement, you’ll only ever have to pay if you are successful in your claim, and the amount you owe is capped at a relatively small percentage of the amount of compensation awarded in your settlement.

How does a no win no fee claim work?

When claims are funded by a no win no fee agreement, we will usually need to take out an insurance policy on your behalf. This policy provides full financial protection in the case that your claim is unsuccessful; rather than leaving you liable for legal fees, we’ll recoup the cost from the insurer.

Where your claim is successful, all legal fees will be recovered from the other side. You’ll only ever need to pay a small success fee, which will be deducted from the compensation you are awarded.

What happens if I lose my no win no fee claim?

Pursuing legal action by way of a no win no fee agreement means that if you lose your case, you don’t have to pay a penny in legal fees. This is because as part of your agreement, we will take out an insurance policy on your behalf that will cover all legal costs in the event that these cannot be recovered from the other side.

The only exception to this rule would be if it was found that you’d acted dishonestly or maliciously in making a claim, or you were found to be in breach of contract. In this case, you could be liable to pay costs.

How much will I have to pay my no win no fee solicitor if I win my case?

The majority of the legal fees incurred throughout your claim will be recovered from the other side if you are successful in your claim. You will need to pay a success fee, which will be deducted from the total amount of compensation awarded in your settlement. This is capped at 25% of the total compensation awarded to you.

Will I have to pay tax on a no win no fee claim?

No, personal injury compensation isn’t taxed in the UK. It doesn’t matter if you are awarded a lump sum or receive several payments over a set period, or whether you settle in or out of court. Any money awarded as part of a personal injury claim is exempt from tax.
